TERMS AND CONDITIONS - NELMOS

1. Purpose of the Service

NELMOS offers a CRM with artificial intelligence agents that allow you to capture, qualify, and manage customers through messaging channels, including WhatsApp, in an automated way.

2. Account and Registration

To use the service, you must create an account with truthful information and keep it up to date. The user is responsible for the confidentiality of their access credentials and for all activity carried out from their account.

3. Acceptable Use

The user agrees not to use the service to:

1. Send unsolicited communications (spam) or contact people without their consent.
2. Engage in illegal, fraudulent activities or activities that infringe the rights of third parties.
3. Violate the usage policies of the integrated messaging platforms, including Meta/WhatsApp.

4. Plans, Payment and Subscription

Access to certain features requires contracting a paid plan. Subscriptions renew automatically according to the contracted period, unless cancelled beforehand by the user. Current prices and conditions are available on the pricing page.

5. WhatsApp Business Integration and Meta Policies

Use of the WhatsApp Business integration is subject to the commercial and platform policies of Meta/WhatsApp. NELMOS commits to complying with those policies, and the user agrees to use the service in accordance with them, including obtaining prior consent from message recipients.

6. Availability and Support

NELMOS strives to keep the service continuously available, although it may be interrupted due to maintenance, technical reasons, or force majeure. Support is provided through the channel and hours indicated for each contracted plan.

7. Intellectual Property

The software, the NELMOS brand, and all elements that make up the service are the property of NELMOS or its licensors. No ownership rights are granted to the user, only a limited, non-exclusive and non-transferable license to use the service for the duration of the contractual relationship.

8. Data Protection

The processing of personal data carried out through the service is governed by our Privacy Policy

9. Limitation of Liability

NELMOS will not be liable for indirect damages, loss of profits, or data loss arising from use of the service, except where applicable law does not permit such limitation. NELMOS's total liability will be limited to the amount actually paid by the user in the last months of service.

10. Termination

The user may cancel their account at any time. NELMOS may suspend or cancel access to the service in the event of a breach of these terms, non-payment, or misuse of the platform.

11. Changes to the Terms

NELMOS may modify these terms to adapt them to regulatory, technical, or service-related changes. Relevant modifications will be communicated to users, and continued use of the service after publication implies acceptance of the new terms.

13. Applicable Law

The service is provided by Nelmos LLC, a limited liability company organized under the laws of the State of New Mexico (United States) pursuant to Chapter 53, Article 19 NMSA 1978 "Limited Liability Company Act", registered with the New Mexico Secretary of State under file number 3251294, with its registered office at 1209 Mountain Road Pl NE, Ste R, Albuquerque, NM 87110, United States. These terms are governed by the laws of the State of New Mexico (United States), excluding its conflict-of-laws rules. Any dispute will be submitted to the competent courts of Albuquerque, New Mexico, without prejudice to any rights granted to the user by the mandatory consumer protection laws of their country of residence.
